Just like everything else, for employers there are rules we have to follow.  Based upon the size of your organization, there are specific federal, state and in some cases, local employment laws that you are required to follow.   For example, below are some of the laws based upon employee size:

All Employers are to comply with:

  • Immigration Reform & Control Act (IRCA) with I-9s:  Do you know how to maintain them?

  • Equal Pay Act: How are men and women performing equal work paid?

  • Fair Labor Standards Act (FLSA):Do you have exempt positions – are you sure they are?  Do you have non-exempt positions that receive overtime?

  • New Hire Report:  Are you reporting new hires to the state for tracking of delinquent child support?

  • Domestic Violence Leave (KS Law): Do you provide 8 days of unpaid leave?

Employers with 15 or more employees:

  • Title VII of the Civil Rights Act:  “EEO is the Law” discrimination and harassment prohibited based upon protected classes.  What are you doing to ensure your employees are protected?

  • Americans with Disabilities Act (ADA):  Are you aware of your responsibility to provide reasonable accommodations for disabilities?

  • Pregnancy Discrimination Act (PDA):  Are you treating pregnancy like other “short-term” disabilities?

Employers with 50 or more employees:

  • Family Medical Leave Act (FMLA):  Do you know when to allow FMLA?

  • Affordable Care Act (ACA):  Are you providing affordable, minimum value health coverage to your full-time workers?  How do you define full-time workers?
